You can use candfit.com to learn about Candfit and to sign up for an account, which comes with a free first interview. If you run one, you need a real job opening and the right to share the candidate's details with us, and a person on your team makes the hiring decision. Candfit's scores are recommendations, not decisions. Paid use is covered by a separate agreement.
About these terms
These terms apply when you use candfit.com or run a free first interview in your Candfit account. They're an agreement between you, and the company you represent, and Candfit LLC ("Candfit", "we", "us"). By using the site or creating an account, you accept them. If you don't agree, please don't use the site.
Using the website
You may use the site to learn about Candfit and to contact us. You agree not to:
- break the law or anyone's rights while using it
- give false information, or sign up for a company you don't represent
- try to break into, overload, scrape or reverse-engineer the site or the service
- upload malware or anything else harmful
The free first interview
When we offer a free first interview:
- It covers one candidate for one real, open role, once per company, unless we agree otherwise in writing.
- It includes the interview questions written from your job description, a Resume/CV screening for that candidate, one interview with the Candfit AI interviewer, and the full assessment with its recording and transcript.
- You confirm that the role is genuine and that your job description is lawful and non-discriminatory.
- You confirm that you may share the candidate's details and Resume/CV with us, and that the candidate may be told the interview is AI-assisted and recorded. Our invitation email tells them both.
- You're responsible for following the hiring, privacy and AI-in-hiring rules that apply to you, including any notices or consents required where you or the candidate are located.
- We may decline a sign-up or end a free interview at our discretion. Free interviews come with no fees and no service levels.
Recommendations, not decisions
Candfit's scores, ratings and recommendations are tools to help your team decide, and they can be wrong. Review the evidence, and have a person on your team make every hiring decision. Don't use Candfit as the only basis for hiring or rejecting anyone.
Candidate data
When we process candidates' personal data for you, you're the controller and we're your processor, or service provider, and we handle that data only on your instructions and under our data processing terms [link to the data processing addendum, or "available on request"]. The candidate notice explains our practices to candidates.
Paid services
Paid use of Candfit is covered by a separate order or agreement, which takes priority over these terms where they differ. Prices are quoted for your volume and aren't published on this site.
Intellectual property
The site, the Candfit name and logo, and the Candfit software belong to us or our licensors. Your job descriptions and the materials you send us stay yours, and you give us permission to use them to provide the service. If you send us feedback, we may use it without owing you anything.
Confidentiality
Assessment reports, recordings and transcripts are confidential. Use them only to make hiring decisions, and share them only with people involved in the hire, such as your client if you're a recruiting firm. We keep what you send us confidential and use it only to provide the service.
Disclaimers
To the extent the law allows, the site and free interviews are provided "as is", without warranties of any kind. We don't promise any hiring outcome, or that the site will always be available or free of errors.
Limitation of liability
To the extent the law allows, we aren't liable for indirect, incidental or consequential losses, or for lost profits, revenue or data. Our total liability arising from the site or a free interview is limited to [US$100]. Nothing in these terms limits liability that the law doesn't allow to be limited.
Indemnity
You'll defend and indemnify us against claims arising from your use of Candfit in breach of these terms or the law, including the hiring decisions you make.
Governing law and disputes
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules, and disputes go to the courts of Palm Beach County, Florida. [Counsel to decide on arbitration, and on terms for customers outside the United States.]
